(“ViaHive”, “we”, “us” and “our”). We Are a Services Hub “Marketplace, We connect professionals (“Pros”) with their clients (“Customers”). As part of this effort, we provide our services online, including via the ViaHive website currently at www.via-hive.com (the “Site”) and downloadable software applications (each, an “App” and collectively with each Site, the “Services”).
Each person or entity (including each Pro and Customer) who uses our Services is referred to as a “user” or “you” or “your”. This Privacy Statement and our Terms of Service (“Terms”) apply to each user.
This document is our statement of our privacy practices (“Privacy Statement”). Among other things, it explains how we and some of the companies we work with collect, use, share and protect the information you provide to us (“your Content” or “User Content”). ViaHive uses log data to review how we provide our Services and to measure, customize, and improve the Services.
How We Store Your Information
We currently provide the Services from within the United States, and we store all User Content, including Personal Data, that we currently collect and retain on servers inside the United States.
Certain types of User Content you submit to us might reveal your gender, ethnic origin, nationality, age, religion, sexual orientation, or other Personal Data about you or others.
By using our Services, or by submitting your personal Information to us, you consent to the collection, storage, processing and onward transfer of your personal Information as stated in the current version of this Privacy Statement and the current version of our other online documents, including the Terms of Service.
How We Use Your Information

Any information or User Content that you voluntarily disclose for use of the Services, such as your user name, your Personal Data or other User Content, may become available to the public if you release it to other users or to the general public. Once you have shared your Personal Data or your User Content with other people, or otherwise made it public, that Personal Data and your User Content may be re-shared by others.
Children
Our Services are not directed to persons under age 18 (“Young Persons”). If you do not have an account, or if you are an authorized agent under CCPA ”California Consumer Privacy Act”,

California Consumer Privacy Act

This California Consumer Privacy Act disclosure page laws and regulations that address privacy rights and responsibilities (collectively, “Laws”) ("Disclosure") supplements the Viahive Privacy Notice and is effective as of Jan, 25, 2022. The Viahive Privacy Notice describes the personal information that we collect, the sources from which we collect it, the purposes for which we use it, the limited circumstances under which we share personal information, and with whom we share it. These additional disclosures are required by the California Consumer Privacy Act:
Currently, ViaHive stores all Personal Data on servers and other machines physically located within the United States.
Protection Against Discrimination
1.1- Viahive will not discriminate against any consumer for exercising their rights under the California Consumer Privacy Act.
1.2 - You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things:
1.3 - Deny goods or services to you;
1.4 - Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
1.5 - Provide a different level or quality of goods or services to you; or Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.
1.6 - Please note that we may charge a different price or rate, or provide a different level or quality of goods or services to you, if that difference is reasonably related to the value provided to you by your Personal Data.
Children’s Online Privacy Protection Act (“COPPA”)
Currently, COPPA ”Children's Online Privacy Protection Act” should not apply to the Services. Each user must be 18 years of age or older. As noted in this Privacy Statement, if we learn any user is under the age of 18, or if any parent or guardian requests we do so, we will delete all information provided by the individual from our Services. Moreover, users of the Services are responsible and liable for compliance under COPPA and are prohibited from collecting, using, and/or disclosing personal information from and about children in connection with the use of the Services, or assisting any third party in doing so.
Ownership of Intellectual Property
All proprietary rights (not limited to copyright alone) in the System, Desgins, Layouts, Colors. logo, name, and all content of viahive, including but not limited to information, to the system flow and coding strecture in viahive software, code, icons, files, images, databases of all viahive clients and providers data, domains, subdomains, Via hive's company property . Any utilization of these assets requires prior written consent from the via hive. These Terms do not grant you any rights to use the System’s intellectual property, the Company’s trademarks or service marks, or any other proprietary rights, unless explicitly stated otherwise in writing. By using the System, you grant us an everlasting, irrevocable, non-exclusive license to utilize, duplicate, modify, publish, edit, translate, distribute, perform, and display the information you provide to the System, as well as any derivative works, in any form, media, or technology, whether existing now or developed in the future. You also authorize us to sublicense these rights. This includes the exploitation of any proprietary rights in such materials, such as rights under copyright, trademark, service mark, or patent laws, under any relevant jurisdiction. Additionally, you waive any moral rights you have in the materials. By providing feedback, suggestions, improvements, enhancements, and/or feature requests related to the services or System, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to utilize, reproduce, distribute, and fully exploit such feedback for any purpose. You are prohibited from using, copying, displaying, distributing, or allowing the use of any content from the System, including the Specialist database. Creating alternative databases is strictly forbidden and constitutes a breach of these Terms and an infringement of intellectual property rights. You agree not to: (i) Remove any copyright, trademark, or other proprietary notices from any part of the System; (ii) Reproduce, modify, create derivative works from, distribute, license, lease, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, or otherwise exploit the System, except as expressly permitted by the Company; (iii) Decompiling, reverse engineering, or disassembling the System, except as permitted by applicable law; (iv) Link to, mirror, or frame any part of the services; (v) Employ programs or scripts for scraping or spoofing or indexing, surveying, or data mining any part of the System, or unduly burdening or hindering its operation and/or functionality; (vi) Attempt to gain unauthorized access to or impair any part of the System or its related systems or networks. We will investigate notices of copyright infringement in accordance with the Digital Millennium Copyright Act. If you believe that any content on the System infringes your work, please provide a written notification of claimed copyright infringement to the Designated Agent for the System, including the elements outlined in the DMCA: a physical or electronic signature of the copyright owner or authorized representative, identification of the copyrighted work(s) claimed to have been infringed, identification of the infringing content and its location, sufficient contact information to reach you, a statement that you have a good faith belief that the use of the content is unauthorized, a statement that the information provided is accurate, under penalty of perjury.
Disclosure of Personal Data Used for a Business Purpose
In connection with any Personal Data we may disclose to a third party for a business purpose, you have the right to know, The categories of Personal Data about you that we Shared and the categories of third parties to whom the Personal Data was Shared, and The categories of Personal Data that we disclosed about you for a business purpose.
